Is a law case legit if it turns unconstitutional?

So, I am in the midst of processing to submit an appeal to my school district because of a decision that has turned unconstitutional. This decision was affective on me and was made by my school's vice principal. Here's pretty much my side of the story.

On January 19, 2011, I was allowed to be put back on the bus after a break from it after a behavior plan (contract) was signed in to effect of early November 2010, because of my actions I have made that had got me suspended twice. My family has construed the suspensions to be based off the victim's possible thought process linking my sexual orientation to my actions. The principal alleged me as a pedophile, which I am not. Never nor will I ever have sexual intercourse between me and a younger child. My actions are purely derived from my eldest brother's actions towards me when he (in numerous times) put his arm around my throat and choked me. Meetings occurred on intermittent dates between the time the contract was signed and the time it became no longer in effect. On intermittent dates, the kids up near the front of the bus would you terms such as "Homo" or "Gay" to describe someone, or something. Also, there have been times during school structured time, that I have heard multiple counts of the term "Gay", and a person offensively acting like a homosexual when they are heterosexual. I have appealed some cases of when the term "Gay" has been used. These new cases have not become appealed. I have appealed only two of the cases on the school bus. One of which was solved and undisputed early in the school year. I have told the Vice Principal of the second case. I am unaware if she did do what she said and talk to the 7th graders of their actions. If she did, then her work had a very weak impact on the boys in the front of the bus. Their usage of the terms still become continuously intermittent. In class rooms, select persons utter the terms or cause an offensive act, and I am near enough to hear it, but the teacher is not.

If those boys are doing that to you, get your bus switched to a different one or confront the school board about their actions. Tell the school board that the principal is doing nothing to solve the case.

Where in your post were you referring to something "unconstitutional"? All I see is that you don't like the common usage of "gay" or "homo", and that's it. Even then, what form of result would you like expect?

That's exactly what I'm aiming for is confronting the school board or the superintendent.

It's cruel and unusual that the 7th grade boys are using the terms within my earshot isn't it? Cruel and Unusual punishments are against the Constitution. I'm kind of looking for people to get a better knowledge of LGBT people so they don't face dire consequences.
 
Okay first off, to me its not good to be gay in the first place and second even If I think its wrong, it doesn't give those boys the right to say that. Also, what grade are you in?

My legit reason to sue my school district is because they are doing barely nothing to stop this sexual harassment.

Its not sexual harassment. Also sex is between a man and a woman and a man and a man. So unless the people who are calling you gay and homo are females, its not sexual harassment.

Also, don't be bringing up the subject of gays being wrong or they can't be born that way, that's another discussion altogether.

Arra, are these comments directed towards you? And have you been to the principal, bus driver, Vice principal, etc?

If so, and they haven't done anything, your right in going to the school board as this is bullying.
 
Some of the things here are pretty funny, others are pretty scary.

You sign off your rights when you go to school, there's really nothing that you can do. People using the terms "gay" or "homo" has nothing to do with the 4th amendment, same reason people can say "nigger", if they aren't directly saying it at you it's not harassment. Changing busses or simply choosing a different bus routine is the simplest answer. There's no reason to get offended by what some ignorant people say.


Speaking of ignorant, your understanding of the world is bizarre taz.

Fair enough; you should have said your civil liberties are being restricted, but from your first post, it seems you attacked/assaulted someone, is that correct? What was the behaviour plan and why did you get it (if you want to say)?

I'm sorry to disappoint you but calling someone "gay or homo" is not punishable by incarceration, in fact, in 86 or so countries, being gay is illegal and some countries, being gay is punishable by death. Those people may get some form of counseling or behaviour bond, but not incarceration. You won't ever stop people using "gay or homo" and there won't ever be a law against it, especially when it can be used non-offensively. Yes, it's a social taboo, but it's not against the law.

It's not directed at you as you said, so it's not sexual harassment.

Besides, what can the school do? They can't exactly stop people from saying particular words. Words such as "homo" and "gay" are often used by younger people anyway as a form of put-downs. It depends on the reasons why they use these words.

There are times when someone will call me gay, but it is kind of rare. I have been a victim of the harassment when it was directed towards me. I've been to the principal, vice principal, even the security guards. Those three were weak on taking care of it. The bus driver is able to hear it almost crystal clearly despite his ripe old age. Yet he is more focused on driving and people standing up instead of sitting down.

Which no offense is way more important than dealing with bullying, at least while he is driving the bus. I'd go see a guidance counselor, they're usually the ones that would be involved in something like this. The other school officials have probably avoiding things because it's simply easier to do than actually try and stop things. In the end though you can't physically stop people from saying things, it's best not to get worked up over it anyway. After all, it'll only harm your physical and mental health.

(unless of course it is constantly directed at you. Then disregard that last comment)
