Small Claims Court?

Have you ever had to take anyone to small claims court? What was the result?
 
Not me personally but a friend had to head that route. It was settled about 2 days before the actual court date, but would have been interesting to see how it played out
 
No. I've never had anyone cross me bad to where I had to take them to court and sue them for damages.
 
I haven't been to one myself. & I honestly don't know of anybody who has.

No, but I've considered it recently. It's just that the contractor I hired is a smooth talker and could potentially make me look like a fool instead of him.

In what way? Did he do a half ass job?

His crew did. He promised me that he had little tricks so that the peg fasteners for the shutters would stay put. They did not stay put. He promised that the foam he uses would keep the birds out. It did not.

But in the written contract, he only wrote it a certain way, so that it didn't include the PROMISE, just the work he would attempt to do.

The foam was a complete failure because it seems to have condensed and I can still see through to the other side of the shutter. The birds easily are making nests and the foam is now a mattress for them.

That's horrible. I'd be really upset. Did you call him and tell him that it fell apart? and Is he going to come back and fix it?

He's been back twice. He's frustrated that I keep bugging him. The last time he told me that the holes are too worn...so why did he make all those verbal promises to me? For the money. We paid $1,100 dollars and we wasted our money. This morning I opened a window and pulled out a large birds nest that was tucked inside the foam. I'm so disgusted.

Are you and your husband documenting the damage? I'd threaten to sue him if he doesn't do it right.

I have kept all the communication and taken photos along the way. I think that we don't trust this guy to actually make things right. He promised us foam and we have foam. The foam is not working. That means when the birds get behind the shutters to build a nest, they pop the pegs out.

I think at this point what we have to do is just hope that the shutters don't fall off this year and maybe next year hire a different contractor to take down all the shutters, add some concrete filler to the concrete ledges that the shutters are bolted into and let that sit for a week to cure. That way new holes can be drilled. To keep the birds out, I'd prefer to go back to the mesh we had before. The birds tend to pull it out if it's in small sections, so that would have to be specified in the contract.
