Don't try to re-start using that database. It's illegal. If the owner found out, they could sue you for damaging rights - Anything upto $500,000. And if it's a big site, you can bet you would get your butt kicked in court. Start again. 😉

I think that's what we were all saying was that it's better to start from scratch. Course, I'm not good at making my responses obvious sometimes, though.
 
Did your contract say you retained any rights to use old database or any intellectual property rights etc? If not, I'd say no.

As for nobody finding it, Google could be called nobody...all it takes is one person keying in something into a search engine that brings up the same post from both forums.
 
Depending on the TOS the users themselves may own the copyright and not anyone else. Still seems you have this settled.

master412160 you should definitely only do what they have given you express permission to do. I once purchased a forum from someone and found out a little later, that they were trying to sell a copy of the forum database without my permission, that's nothing short of theft in my opinion. When you sell something, you no longer own it and you no longer have any rights to use it, unless the new owner gives you that permission or your right to re-use it was a term of the deal you made with the buyer.
 
I think its "cheating" by opening a forum with an old forum database. IE tricking members in to thinking the forum is really active when it isn't. "Whats the worse that could happen?" You could be shut down, and lose all your new content cause of it. And if you opted to use it any ways permission or not, I wouldn't of told the new owner as that guy could wait a few weeks then report you if your become more of a success of a forum then hes.

Start fresh, new ideas and what not.
