The most vital thing, in my opinion, is that there be a list of things that the government simply cannot do. For example, restricting freedom of speech and press should be constitutionally barred.

You oppose a bill of rights, then? That's basically what a bill of rights is. It's a list of things that the government cannot do. I'd say both of those plus the "Promote" in "Promote the General Welfare" are ignored. Because, if you know what it means, the government actually cannot give away any welfare checks. They can't do affirmative action, either. But no one pays attention to the Federalist Papers these days. Except Glenn Beck.
