March last year the law firm Dunlap, Grubb and Weaver imported the mass litigation “pay up or else” anti-piracy scheme to the United States, and in the month that followed they targeted nearly 100,000 people.

In total, cases have been filed against more than 200,000 alleged infringers, many of which are accused of downloading and sharing adult films.

A significant number of the defendants are likely to be guilty, but there’s also a lot of collateral damage. Firstly it’s unclear how accurate the evidence gathering techniques of the copyright holders are, and even when they have the correct IP-address it doesn’t necessarily follow that the account holder on file is actually the infringer.

Doe 2,057 in the case of Imperial Enterprises v. Does claims to be one of these wrongfully accused persons.

This May he received a letter from Comcast informing him that Imperial Enterprises had filed a lawsuit against him for illegally downloading and sharing one of their adult titles — Tokyo Cougar Creampies. To some people this title may seem inviting, but it’s not the type of content Doe 2,057 is interested in.

Not least because he’s legally blind.

“To be honest, it’s a little ridiculous. My movie-watching ability is nonexistent. My kids watch movies, but they are 4 and 6, so they don’t watch porn either. Well, hopefully they don’t,” the Doe told the Village Voice Media.

Another brilliant move by our friends in the extortion entertainment industry, these blind people are seriously ruining porn and movie sales with their blindness. I mean WTF, just because you're blind doesn't mean you should'nt buy porn and go to the movies, freaking freeloaders :roll:
 
How did you get that out of that article? How do you get a blind person buying movies that he CANNOT OBVIOUSLY WATCH, DUE TO THE FACT THAT HE IS BLIND?

And at 15 years old, do you really know enough about life to know how IP addresses are given out? For example, everyone on one street can be using the same internet service provider, and virtually have the same IP address.

Oh, yeah, plus the fact that in the U.S., it is supposed to be innocent until proven guilty. Unless you can come up with unknown facts that make blind people guilty of watching porn that they obviously cannot watch, the person is innocent. 😛
 
Unfortunately, "innocent until proven guilty" is a thing of the past in the United States.
 
Thats sad, this is why this whole witch hunt thing simply isn't going to work. They really have no proof in a lot of these cases but since almost everyones downloaded a song at least once they just use scare tactics.

Quite the contrary, the new thing in a good amount of cases is to point blame, then prove they are innocent. For example, I can tell a girl that I don't want to date her anymore, due to how she acts, and the girl can go to a judge and cause me to be put into jail for some other reason, other than the fact that I might have hurt her feelings. Can you see this now?

The system in the U.S. is supposed to be Innocent till proven guilty. For the example I gave, Yes, I would be guilty of breaking up, but I would be innocent of any charge she tries to bring against be, all because that she had her feelings hurt.

That in itself would be Guilty, until Proven Innocent, which countries that have no freedoms practice on a daily basis.

The company that is doing this, is trying to make it look like the person is guilty, even before the trial, so that is going opposite of how the system is SUPPOSED to work.

So? Do you not realize that the poor movie makers need to make a living? Pirates are EVIL!!!! I mean every time they download their free porn the movie industry loses all of their money!! These corporate guys are starving to death, downloading movies is like the equivalent of stealing clean water from children in Africa!


But now I guess its time to be serious, I thought the sarcasm was clear in my first post xD. Anyway, this is the new way that the porn industry makes all of its money. They used to be fine with piracy as its great for the physical products they sell, but now they've realized they can make a shitload of money through extortion.

Also, you realize that this dude's info was given to the LAWLyers by Comcast? What happens is these scum bags track I.P.s from a torrent's swarm and send the info over to the ISP, who then either sends the customer a letter telling them piracy is bad, or in cases like this takes a small bribe from the porn guys and sells the info to them. Says it in the article if you read it.

The trick to all of this is these guys will never actually take you to court in the first place, that costs way too much. Instead they just extort money by sending letters asking for $x,xxx and say they'll sue you if you don't pay up. AC:S Law got screwed by this, but the P.O.S. that ran that place deserved it. Of course instead of our govt following the UK we let these kind of places thrive here.
 
I think it's ridiculous that private corporations can get private information from ISPs. Our laws (albeit quite dumb) should be enforced by our police, not by corporate greed.

The problem is the people still have a tiny amount of input into what our government does, at least for a fraction of their crazy ideas. With private corps they can do whatever the hell they want. An agreement already passed with all major ISPs in the states for them to hunt down pirates on their networks and slow down their internet or cut them off. mafiaa thinks this will stop piracy. As far as I'm concerned I'm either getting a VPN or more likely a seedbox now, will help with my ratio on the trackers I use so the govt is actually doing me a favor.
 
I don't think that is near necessary because there are blind people downloading illegal films that they can't watch because he is blind, but what makes it more weird is how they downloaded it illegally. Especially because he has children as well, but hopefully he will become guilty. That is a horrible case of what they did. They just downloaded it so that they can make the movie industry people miserable? That's not right.

What do you mean? It makes a perfect amount of sense that they are downloading something that they can't even watch.

I don't think there will be many differences at all between Canada and the United States once Harper is done with you guys. It's a shame, too. Now I have to move to Europe for refuge. 😉

P.S. This thread may be moved to the debate forum in the near future if it turns into a debate. Right now, it's more of a news thread than anything. 😉
