Website owner gets suspended jail term sex-scene pictures posted

The owner of a message-board website got a suspended one-year jail term and a fine of Bt20,000 after a user posted sex-scene pictures of a Thai woman on his site.

The Criminal Court found Pongwit Singsun 23, guilty of violations of the Computer-Related Crimes Act for allowing his website to be used to damage another person's reputation.

Public prosecutors charged that the crime took place from October 6 to November 30.

A user posted the sex-scene pictures of a woman in Nakhon Sawan, who alerted police.

The court initially sentenced Pongwit to years and fine of Bt40,000 but commuted the penalties by half after he pleaded guilty.

The court later suspend the one-year jail term and put him on probation for two years during which he must report to probation officials for eight times. He is also required to carry out social service for 48 hours.

In the future, we may decide where to host our forums based upon the local laws in each jurisdiction -- and we may decide where to live based upon the same criteria.

Wait, so a guy posted an image of a nude woman on his site and he takes the fall for it? Wow, if that was the case then I'd be in jail for the past four years. Porn bots and the like.

Just want to know if he deleted the images once he was made aware of them.

Meh. This sucks... though I think he should have been contacted by the woman and alerted to the fact that she wanted them taken down... it's not the admin's job to decide what is legal or not, he has to assume that his members only post good data.

That's like skipping the whole "DMCA" alert process and going directly to court, it's bull**** is what it is.

I believe as administrators and moderators of such sites we have a duty to police our forums. I agree with the courts decision. If he knew that the porn was present, then he should have deleted it.
