Thats because he sold the skin to Fergal, so Fergal owns it, and iCrazy owns the FC skin, so iCrazy can get the skin taken down off other forums.

He wouldnt need to go to court, he can contact the DMCA I believe, which can take it as far as the host taking the site down..

Personally if anyone were to use the skin, it just shows they've got no respect for someone else's work (this case being Christians) and they've got no respect for the person who brought it (in this case being Dylan) therefore it wouldn't take much effort to make them crack.

Forum Crazy has put in safeguards to prevent others from sharing the FC style.

If you steal a skin, which is not yours and you do not have permission.
The host will remove you from their servers, otherwise Crazy can sue the host for having his things on their servers.

Do you think that a host will take the risk? I don't.
