Years ago I had made a website about a Tv show(fan page), using Flash only.And now these days I want to make another website a lot.But I have some concerns about mywebsite getting hacked and it's consequences.
From what I have read online, if a website contains personal information about it's visitors, like name,address, credit card... and if it gets hacked and hackers access to those sensitive information, the owner of the website can get into serious legal trouble, including high financial fines.And even giant websites like yahoo,facebook,google gets hacked.These kind of breaches, when the hacker gets access to sensitive information of visitors stored on the website, is called "data breach", if I didn't understand it wrong.
Now, the part which I didn't understand is, what happens if a website doesn't store any sensitive,personal information about it's visitors but if it gets hacked and hackers start distributing malware without the knowledge of the website's owner and they continue doing that until the owner of the website becomes aware of it and stops them, what are the legal consequences of it for the owner of the website?Would he be in legal trouble like he would be if his website was storing sensitive information of visitors?
Also does the hosting of the website matter in such cases?I mean shared hosting,vps hosting,cloud hosting,dedicated server...does it matter legally?
