I would allow this because it's goofy for someone to tell you where you can or cannot smoke outside. If you don't like it, then feel free to walk 3 feet away from the one smoking.

People have the right to do whatever they want to do with their bodies. I don't smoke anymore, but I don't have a problem with people smoking. It's their body and their choice. Plus, banning cigarettes would just create a massive black market which would be equally as dangerous as the drug market. Cigarette costs would be sky high and people would literally be willing to steal for them. People could grow tobacco, but not everyone is going to do that. You'd basically be turning innocent people into criminals.

Most public spaces don't allow smoking already. Your argument would be understandable if it were still the early 2000s where you could smoke in iHop, but that's no longer the case. Out in the open, you can move a few feet away from the person smoking and you'll be fine. I can understand bans like: "No smoking in a restaurant, no smoking with children in the car", but to ban smoking completely is absolutely stupid. Police are messin' people over enough, I can't believe people really want to give them the ability to fine people or even jail them for smoking. Even if there wasn't a fine or jail, it'd be an absolute waste of resources to ban the stuff. Also, after the ban how are we going to replace the 8-15 billion dollars that the government makes from taxing tobacco?
