Well first of all considering it's illegal you shouldn't be wondering, although there is a massive site on this, search it in google cause im not going to link you, but the keywords:

Any private server other than MU is currently illegal. Good choice 😉.

The only way it's not illegal to do so is if you have gotten consent from the original game maker, an example would be:

Hong Kong with Maplestory who don't allow their population to play the original Maplestory got consent from Nexon by paying them a huge $ amount to run their own official and legal server.
 
Running a private server is not illegal.

However Playing on one is against the end user license agreement of most mmo's,
Since you require their client to play on the private server.

Actually making and running one is also illegal, if it wasen't then you wouldn't see the private server's TOS be so strict against the actual game makers, for example a rs private server would have this line in their TOS:

"You must not be a Jagex LTD employee or anyone associated with Jagex, being family, friends or even neighbor it is strictly prohibited to continue past this point if you are one"

Or something along those lines.

If you don't believe me or want more information you should email jagex, finding their email on their site.

Actually Reverse engineering protected, And Emulators are not developed by jaged ltd, blizzard, and so on. So its not their property. A private server only allows people to connect, using A/The official game client.

See below, how Blizzard tried to stop private servers, and failed.

Some individuals may have helped develop emulator servers under the belief that Blizzard was not opposed to the existence of illegal copies of the World of Warcraft beta game client. Blizzard places a high value on its intellectual property and does not condone illegal copies of the beta game client or software that facilitates or encourages the use of illegal copies of the beta game client.

Leaders from various emulator-server development teams, including StormCraft, Vibe, and Khaos, have turned over their code and stopped development of emulator servers. We are asking that those of you who are continuing to operate unauthorized emulator servers for the World of Warcraft beta take this opportunity to voluntarily stop these efforts and turn over your code to Blizzard as well. If all these private servers were allowed then there would be no need for the TOS the site's have nor would there be the need for any copyright that the actual game makers have on their games. If you host a server you'll get a DCMA complaint, it's just like running nulles software such as vb or IPB etc. it's not allowed.

I have been hosting all sorts of emulated servers since 2004. No lawsuit's yet.
Theres nothing jagex, and all the others can do to prevent it.
Except banning all those who play on a private server, But they dont do that either. Big waiste of money.
 
Well goodluck with not getting caught, it is illegal and it's obvious why it is, i mean you are using their COPYRIGHTED game, images, concept and everything. Anyways have fun with your severs.

MoparScape is a good place to learn, that's where I first opened my RSPS. Oh by the way.. Jagex took down my RSPS..

By the way, check out Hamachi too, it's good if you want your RSPS to be private, you know just you and your friends/family etc.

But it's not for learning purposes is it, that's just the excuse everyone uses to get around it. If it were for learning purposes everyone wouldn't need offshore hosts, huge copyright notices etc.

Lol I stated in my servers TOS that it was for learning purposes and that if any Jagex people or whatever come on my server/site I am allowed to take legal action.

But that is all BS people put in their TOS and think they are safe. Well your not, trust me...
 
It's not legal by any means, if you create a pirate server, Jagex can and will take action against you.
 
Yes, When I make mine it is for learning purposes I only let a couple friends on here and there. It's very useful to learn javascripting and game scripting altogether 🙂
