In a move that surely delighted Activision detractors, the "evil corporation" is in a battle to win back its own domain name, www.modernwarfare3.com. The site is currently inaccessible, but over the weekend it was uncovered to be a domain bashing the upcoming Modern Warfare 3 and redirecting to EA's web page for Battlefield 3. Activision has since filed a complaint against the URL at the National Arbitration Forum for a fee of $2,600.

While it's quite a predicament that Activision has found itself in, it's amazing that it happened at all. Part of me wants to think that this may have went over Activision's head while in the middle of the whole Jason West and Vince Zampella ordeal last year where the company feared it may not have had the "Modern Warfare" name for future titles, anyway. But, really, with the ease of registering a domain (and relative affordability), it's a wonder Activision wouldn't have secured the site (and the brand) years ahead of time.

Apparently the owner of Modernwarfare3.com redirected the site to Battlefield 3's site, CODs biggest competitor.

Should activision be allowed to take this domain just because of the game title? Someone could make a game called Forum Promotion, but shouldn't be allowed to seize the domain.

Lol, a game of forum promotion 😛 Its a good point, they were beaten to the punch and whoever owns modernwarfare3.com should be very happy 🙂

Activision certainly should receive modernwarfare3.com. Just because somebody registered modernwarfare3.com doesn't mean they own it, especially with Modern Warfare being an established brand.

You know that 'Modern Warfare' as a game series is trademarked, right? That means it's illegal to use Modern Warfare within the context of video games with the go ahead from Activision and that's exactly what happened with whomever registered modernwarfare3.com. It's cybersquatting and if/when this goes to court, there's an incredibly small chance Activision would lose.

Activision has every right to dispute this domain. "Modern Warfare" is a trademarked term, and using the domain is illegal, furthermore, by bashing on the game they are committing defamation, which is also illegal.

Forumpromotion is not a trademarked term, nonetheless it is very generic. Furthermore, the game isn't defaming forumpromotion.net, if it was, Fergal would have the right to take legal action.

It breaks no law, they should have to buy the domain from the current owner.

It actually breaks multiple laws.
I'm pretty sure it only breaks about two, either way, they still own it.

Breaking one or seventy three laws, it's still breaking something which gives Activision all right to rip this bloke a new assh*ole.

lol @ The Reverend. "Hey guyz im an antiarchahist and like i hate da law and stuff, laws yes!" Democrats hate freedom as much as repooblicans. Furthermore, you support breaking the law like having 40 year olds rape 11 year olds too? Breaking the law to break the law is fooken st00pid.

Um, no. I dont talk like that, I've no idea what you're on about. I dont hate the law, if we didnt have laws, the majority of us would be dead or injured.

You just called someone a right winger for agreeing with international law. That's an extremely low blow for something that minor IMO.
