I know most forum software already has a terms of service agreement and I have seen a lot of forums that also create their own. My question is should I find a generic one, leave it as is with the software TOS or what? Does anyone bother using it?

Depends really about what you need. If the regular TOS is enough for you, then there's no need to change. If you need to add something to it, then just go ahead.

It all depends on your forum niche, some forums need to tweak the TOS a bit to not get in trouble or to keep trouble away.
I usually like to write the TOS (pretending to be a lawyer and such its fun xD)

I always get that thesaurus out when writing privacy policies and terms of services. It's always nice to sound smarter than you really are when typing normally 😛

Hehe I agree, but you have to admit its fun writing it and after all its something important to the forum so it should be taken care of well.

I actually read a study which ended up saying that when people try to sound smarter they actually aren't, which is quite interesting.... I think it was more of an in person thing though.

You're better off editing the original TOS to suit your needs, but it's quite rare that it needs to be tweaked. You don't want to write it from scratch because you want a fairly high quality job and one that was already professionally done. But if you really want to, why not? 😛

The best thing to do is as you stated editing the original and making it suit your forum needs. Writing it from scratch may leave you defenseless against certain violations that you may forget to state in the TOS.
