I know most forum software already has a terms of service agreement and I have seen a lot of forums that also create their own. My question is should I find a generic one, leave it as is with the software TOS or what? Does anyone bother using it?

The best thing to do is as you stated editing the original and making it suit your forum needs. You're better off editing the original TOS to suit your needs, but it's quite rare that it needs to be tweaked. You don't want to write it from scratch because you want a fairly high quality job and one that was already professionally done. But if you really want to, why not? 😛
